What is a working day in the UK?

In all the European countries, the work week is from Monday to Friday. We therefore count as average 5 business days – or working days – in a work week. The exact definition from the FCA is ‘any day other than a Saturday, a Sunday, Christmas Day, Good Friday or a day which is a bank holiday under the Banking and Financial Dealings Act 1971 in any part of the United Kingdom.’

Week-end days and public holidays are therefore not considered as working days.

Of course, some people may work during week-end days or public holidays but that is not the majority.

What are the working time regulations in the UK?

In the UK, the working time directive stipulates that you can’t work more of 48 hours in a week averaged over 17 weeks.

The working time is calculated over a reference period of 17 weeks meaning that you can work more than 48 hours one week or more as long as your working time over 17 weeks is less. This limit also applies to people with several jobs. The only exception to this rule is for people working on the offshore oil and gas section (weekly working time is averaged on 52 weeks) and trainee doctors (working reference of 26 weeks).

What if I want to work more than allowed by the working directive?

If you want to work more than 48 hours a week, you must sign an ‘opt-out’ agreement. You can download our free opt-out agreement template below. If you want to cancel this agreement, you will need to give at least a 7 days notice to your employer (although it is recommended to give more to keep good relationship with your employer).

Airline stewards and staff, truck drivers, bus conductors, security guard or workers on boats or ships are not allowed to sign any opt-out agreement.

If you are under 18, your weekly working time is not averaged and you are not allowed to work more than 40 hours in a week.

What is considered as working time?

  • any working time as defined in the contract
  • a training related to a job
  • time on call at the workplace
  • travel to and from the workplace
  • paid overtime.
  • standard lunch breaks
  • travelling outside working hours (even for work)
  • holiday whether they are paid or not
  • unpaid overtime.
